GENERAL TERMS AND CONDITIONS OF SALE

1. Purpose :
All orders placed on the Internet via the website of WELLNEST RETREATS NV, under the address www.wellnest-retreats.ch, are governed by the present General Terms and Conditions of Sale, which shall apply to the exclusion of all other conditions. By placing an order, you acknowledge that you have read, understood and accepted, without any reservation, the present General Terms and Conditions of Sale.

The present general terms and conditions of sale apply between WELLNEST RETREATS SA, whose registered office is located at 11 chemin de Clairejoie, 1225 Chêne-Bourg in Switzerland, registered in the commercial register of Geneva, Switzerland - CHE254.387.497, and on the other hand, all natural and legal persons making a reservation and/or a purchase via the WELLNEST RETREATS SA website, under the address www.wellnest-retreats.ch.

WELLNEST RETREATS LTD reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on its website. In the event of a change, the General Terms and Conditions of Sale in force on the website at the time of placing the order shall apply. Each order placed implies approval of the General Conditions.

2. Registration:
By registering on this site, you declare that you are at least 18 years old and have full legal capacity. You must ensure that the mandatory data you provide is accurate and complete.

3. Booking and Ordering:
By confirming a reservation for a holiday or by placing an order on this site, you undertake to purchase the holidays and/or products that you have selected in accordance with these General Terms and Conditions of Sale. The reservation and/or order is considered final as soon as you have validated the transaction on the site.
WELLNEST RETREATS SA offers its holidays and/or products for sale on the present site within the limits of availability.

4. Confirmation of reservations and orders:
Reservations and orders that you place on this website do not constitute a binding contract until they have been confirmed by an e-mail from WELLNEST RETREATS NV and after your full payment for your reservation and/or order.
WELLNEST RETREATS NV reserves the right, at its discretion, to refuse a reservation and/or order.

5. Prices :
The prices indicated on the website are expressed in Swiss Francs. All orders are payable exclusively in Swiss Francs.
The prices invoiced are those in force on the date of the order and appear on the order confirmation, including VAT, preparation and delivery costs.
WELLNEST RETREATS AG reserves the right to change its prices, processing and shipping costs at any time.

6. Service and delivery :
WELLNEST RETREATS SA undertakes to deliver the services of your stay, or to ensure the delivery of your products in the best conditions.
The order will be sent to the address indicated by the purchaser during the validation of the order.

7. Checking the quality of the services and goods delivered:
It is your responsibility to check the goods immediately upon delivery and to make any reservations and complaints regarding possible defects or non-conformity.
These reservations and complaints must be sent by e-mail to contact@wellnest-retreats.ch as soon as possible but no later than 3 days after delivery.

8. Payment:
Payment shall be made in full or in part of the total amount prior to the confirmation of the booking of the Service(s) by WELLNEST RETREATS Ltd. or the sending of the order. Each payment shall be made by bank transfer to the current account of WELLNEST RETREATS NV, which shall be communicated to the customer during the reservation or order process, with all the usual details: name of the bank, address, BIC and IBAN. Each payment and bank transfer shall only be deemed to have been made once it has been credited to the bank account of WELLNEST RETREATS Ltd. and net of any bank charges (transfer fees, conversion, etc.).

It should be noted that for the payment and transfer methods, it is understood that
(i) For all bookings and payments for stays: 50% of the total amount including VAT is to be paid at the time of booking, and the remaining 50% 7 days before the departure date of the stay
(ii) For all orders: 100% of the total amount is to be paid at the time of order and before delivery

9. Cancellation of stays and return of goods:
You have the right to cancel or retract your booking or order, or after receiving the goods, without having to justify your reasons or pay any penalties, according to the conditions and deadlines indicated below. Please note that the date of receipt of the written cancellation is decisive.

A. Right to cancel a stay : Please note that a handling fee of CHF250 per client and per stay will be retained by WR before any refund, to cover in particular the costs related to the organisation and exchanges (questionnaires and/or interviews) during the pre-stay phase. In addition, you may request a refund according to the conditions below:

• Up to 30 days before the arrival date: full refund of the deposit paid.
• From 29 days to 8 days before the arrival date: the deposit paid is kept as a credit, for a next stay within the next 12 months.
• From 7 days to the day of arrival: the full stay will be charged.

B. Right of withdrawal :
WELLNEST RETREATS AG only accepts returns of goods in good condition and in their original packaging together with the invoice. The costs of returning goods are to be borne by the customer.

According to the above scenarios A. and/or B., you will receive a refund within 30 days of exercising your right of withdrawal. A cash refund is excluded.
In order for WELLNEST RETREATS AG to be able to make this refund, you must inform us in advance by e-mail (contact@wellnest-retreats.ch). In the case of orders, and after agreement, you send the goods back to us in the original packaging with a copy of the invoice. You are responsible for the shipping costs.

10. Data Protection:
WELLNEST RETREATS SA undertakes to treat your data confidentially in accordance with the General Data Protection Regulation (GDPR, Regulation nᵒ 2016/679), and not to pass it on to third parties without your consent. Please see our Privacy Policy. Acceptance of our terms and conditions constitutes acceptance of our Privacy Policy.

11. Liability :
Certain photos and texts illustrating the WELLNEST RETREATS SA website are non-contractual and for information purposes only. Those describing the stays, places of accommodation, workshops or products that appear on this site are contractual. WELLNEST RETREATS SA assumes no responsibility for any errors or omissions in the photos or texts appearing on this site outside its online shop.

12. Force majeure :
WELLNEST RETREATS SA shall not be held responsible for the cancellation of stays, delays or non-delivery due to circumstances beyond its control, such as strikes, wars, sanitary and pandemic restrictions, natural disasters or others that prevent the reception and management of our stays or their activities and workshops, the production, transport or delivery of products.

13. Law & Jurisdiction:
The present General Terms and Conditions of Sale are governed by Swiss law.
All our conditions of reception and management of our stays in any hotel or other structure in Switzerland, strictly respect the directives of the Swiss Federal Office of Public Health (FOPH), then the directives required by each reception centre.
The place of jurisdiction is the registered office of WELLNEST RETREATS SA.
